Marriage to a US citizen can lead to citizenship, but there is a process that must be followed. It includes living together in the US for a substantial amount of time, filing of the right paperwork, and going through an interview.
For a non-US citizen who is married to a US citizen, there is a pathway to becoming a US citizen. However, there is no shortcut by getting married in Mexico and expecting automatic US citizenship.
The only way to become a US citizen through marriage involves getting married in the United States.
Marriage outside the United States does not automatically grant citizenship to the foreign national spouse, but it does start the application process forward.
Getting married in a country other than the United States involves more steps in order to become a citizen, including obtaining an I-130 petition, having a medical examination, and possibly even attending an interview.
After these steps are completed, the applicant must enter the US with an immigrant visa and live with the US citizen spouse within the US.
The couple will then be required to file another petition, known as an I-485, to adjust the applicant’s status from conditional permanent resident to a lawful permanent resident.
Permanent residents can then apply for US citizenship after five years of permanent resident status.
There is no need for a foreign national spouse to get married in Mexico to start the process of eventually obtaining US citizenship.
Getting married in Mexico does not change the process or accelerate it.
Instead, foreign nationals who are already legally married to a US citizen should submit the proper forms to the USCIS as part of the first steps of the citizenship process.
