California Child Front Seat Law: Exceptions for Under 8

California law (Vehicle Code §27360) generally requires children under 8 to ride in a rear seat in a proper child restraint. However, exceptions allow front-seat riding if ALL these conditions are met:

Legal Exceptions (All Must Apply)

1. Height: Child is at least 4'9" (57 inches) tall
2. Airbag: Vehicle has no front passenger airbag OR airbag can be manually deactivated
3. Proper Restraint: Child is secured in a federally approved child restraint system appropriate for age/weight/height
4. Adult Supervision: Child is accompanied by a parent, guardian, or adult ≥18 years

Standard Requirements (No Exceptions)

• Under 2 years: Rear-facing car seat (unless ≥40 lbs or ≥40 inches)
• 2–7 years: Forward-facing car seat or booster seat
• 8+ years OR 4'9"+: Vehicle seat belt (if fits properly—lap belt on thighs, shoulder belt on chest)

Critical Safety Notes

• Rear seat is always safer—airbags deploy at 200+ mph, designed for adults
• If rear seats exist, use them. Front seat only if no rear seat (e.g., 2-seater truck)
• Never place rear-facing seat in front with active airbag—fatal risk
• Violations: $100+ fine, 1 DMV point (first offense)

Best Practice

Keep children in the back seat until at least age 13. The American Academy of Pediatrics and NHTSA recommend this regardless of height. California law sets minimums; safety experts recommend maximums.
