Disabled Renters Rights

Disabled renter's rights are designed to ensure an individual with some sort of disability is able to obtain appropriate housing otherwise available to individuals without any sort of handicap. The Fair Housing Act and Fair Housing Amendments Act are the laws that govern disabled renter's rights.
  1. Application

    • One of the primary disabled renter's rights is a landlord is prohibited from inquiring whether a person is disabled in any way during the lease application process.

    Reasonable Accommodation

    • Another of the disabled renter's rights is that of the landlord making reasonable accommodations to ensure a disabled tenant is able to make maximum use of the rental premises. Reasonable accommodation includes providing the tenant an easily accessible parking slot.

    Reasonable Modifications

    • A disabled tenant possesses the right to make reasonable modifications to the rental premises--at her expense--to render the property more usable.

    Proof

    • When a renter is seeking a reasonable accommodation or to modify the premises, she must provide the landlord with documentation supporting the existence of a disability.

    Resources

    • The U.S. Department of Housing and Urban Development and the National Fair Housing Alliance offer resources to assist in enforcing disabled renter's rights.
