Most Recently Established Territory: British Indian Ocean Territory (1965)

The British Indian Ocean Territory (BIOT) is the most recently established British Overseas Territory, created on November 8, 1965 by the British Indian Ocean Territory Order 1965 (SI 1965/1920).

Formation Context

  • Detached from the Crown Colony of Mauritius prior to Mauritian independence (1968)
  • Also included Aldabra, Farquhar, and Desroches from Seychelles (returned to Seychelles 1976)
  • Core territory: Chagos Archipelago — 55 islands, 60 km² land, 60,000 km² EEZ
  • Largest island: Diego Garcia (27 km²) — hosts US/UK military base since 1971

Contested Status

  • Mauritius claims sovereignty — ICJ Advisory Opinion (2019): UK administration unlawful; UNGA Resolution 73/295 demands withdrawal
  • Chagossian displacement: 1,500+ Ilois forcibly removed 1967–1973 for base construction; ongoing litigation for right of return
  • UK position: "Defence purposes"; no timetable for cession; 2022–24 negotiations with Mauritius ongoing

Other Recent Territory Creations

For comparison, other late-20th century British territory changes:

  • Hong Kong: Sovereignty transferred to China 1997 (not a new territory)
  • South Georgia & South Sandwich Islands: Separated from Falklands 1985 (previously dependency)
  • British Antarctic Territory: Formed 1962 (claim suspended under Antarctic Treaty)

BIOT remains the last new British Overseas Territory created by Order in Council. Its future is subject to active international legal and diplomatic processes.
