Disability retirement in Georgia is open to any individual who has been a member of the Employees' Retirement System for a minimum of 13 years, four months. Additionally, a person must have a permanent disabling condition to qualify.
Eligible disabilities are outlined by the state of Georgia under O.C.G.A. Section 47-2-123(b.) This states individuals must be medically or physically incapable of completing duties in their present position or in an alternative position. The disability must be considered permanent.
An applicant will be offered an alternative position if it is available. This position must be in line with the individual's physical limitations, at equal or higher pay compared with the current position.
The application for disability retirement must be submitted through the human resources office, which will forward it for further review. The state retirement agency will perform an interview within 10 days to determine eligibility and offer alternative positions if they are available.
The decision of disability eligibility is made by a medical board. This board consists of medical professionals and specialists who independently review the application, considering all relevant information.
