Virginia Boating Accidents: Legal Duties Every Operator Must Know

Immediate Legal Obligations Under Virginia Law

Virginia Code § 29.1-738 mandates specific actions for any vessel operator involved in an accident. Failure to comply can result in severe criminal penalties.

1. Stop and Remain at the Scene

The operator must stop the vessel immediately and remain at the scene until all legal duties are fulfilled, provided doing so does not endanger the vessel or passengers.

2. Render Aid

You are legally required to provide reasonable assistance to anyone injured—including administering first aid and calling 911 or the Virginia Department of Wildlife Resources (DWR) for emergency medical transport.

3. Exchange Information

You must provide the following to the other operator(s) and any injured parties or property owners:

  • Name and address
  • Vessel registration number
  • Vessel license/identification number

4. Report the Accident to DWR

A written report must be submitted to the Virginia Department of Wildlife Resources if the accident involves:

  • Death or disappearance of a person
  • Injury requiring medical treatment beyond first aid
  • Property damage exceeding $2,000 (updated from $1,000)
  • Damage to a vessel operated by the Commonwealth

5. Critical Deadlines

  • 48 Hours: Written report required for death, disappearance, or injury.
  • 10 Days: Written report required for property damage only (over $2,000).

6. Cooperate with Authorities

Upon request by a Conservation Police Officer, you must provide all relevant information, documents, and reports related to the incident.

Bottom Line

Treat a boating accident with the same gravity as a car crash: Stop, Help, Exchange, Report. When in doubt, call DWR Dispatch at 800-237-5712.
