In Oklahoma, it is illegal to operate a motor vehicle without the permission of the owner. Depending on the circumstances, unauthorized use of a motor vehicle may be considered a misdemeanor or a felony.
Misdemeanor
If the value of the vehicle is less than $1,000, unauthorized use of a motor vehicle is a misdemeanor punishable by up to one year in jail and/or a fine of up to $1,000.
Felony
If the value of the vehicle is $1,000 or more, unauthorized use of a motor vehicle is a felony punishable by up to five years in prison and/or a fine of up to $5,000.
Enhanced Penalties
Certain factors can result in enhanced penalties for unauthorized use of a motor vehicle, such as:
- If the vehicle is stolen from a dealer or rental agency, the penalties may be doubled.
- If the offender has a prior conviction for unauthorized use of a motor vehicle, the penalties may be doubled.
- If the offender is under the influence of alcohol or drugs while operating the vehicle, the penalties may be enhanced by up to one year in jail and/or a fine of up to $500.
Restitution
In addition to the criminal penalties, the offender may also be required to pay restitution to the owner of the vehicle for any damages that were caused.
