Car Repossession Timeline in New York: Minimum 28 Days After Default Notice

In New York State, a creditor can repossess a vehicle after a default on the loan/lease, but must follow strict procedures:

  1. Send a Notice of Default and Right to Cure (by certified mail or personal service).
  2. Wait at least 28 calendar days (4 weeks) after the notice is received/served.
  3. If the borrower hasn't cured (paid arrears + fees), the creditor may repossess without further court order (self-help), provided no breach of peace.

The 28-day minimum is statutory (UCC § 9-609, NY UCC). Some contracts may allow longer cure periods. Repossession agents must be licensed. Borrowers have rights to redeem (pay full balance + costs) before sale. Consult a consumer attorney if facing repossession.
