Passenger Limits for 16-Year-Old Drivers in New York State
New York's Junior License Passenger Restrictions
In New York State, a 16-year-old driver holding a Class DJ (Junior) License faces strict passenger limits designed to reduce distracted driving risk.
The Rule
Only ONE passenger under age 21 is allowed, unless that passenger is a member of the driver's immediate family (parent, guardian, sibling, step-sibling).
Details & Exceptions
- Supervising Driver Exception: If a licensed driver age 21+ (parent, guardian, instructor) occupies the front passenger seat, the under-21 passenger limit does not apply.
- Immediate Family: Brothers, sisters, step-siblings, and children of the driver are exempt from the count.
- Time of Day: This restriction applies at all times, not just at night.
- Upstate vs. NYC: The rule applies statewide. However, in NYC (5 boroughs), a Junior License holder cannot drive at all (only a Class D license permits driving in NYC, minimum age 17 with driver ed, 18 without). A 16-year-old with a DJ license may drive in Nassau, Suffolk, Westchester, Rockland, Putnam, and upstate counties.
Penalties
Violation is a traffic infraction: fine up to $100 and mandatory 60-day license suspension for a first offense; longer for subsequent offenses. It also delays eligibility for a senior (Class D) license.
Rationale
Research shows teen crash risk increases exponentially with each additional teen passenger. NY's Graduated Driver Licensing (GDL) law aligns with NHTSA best practices.
