Eluding a Police Officer via Motor Vehicle (Virginia Code § 46.2-818)

- Class 6 Felony: First offense, no injury

- Up to 5 years in prison, or up to 12 months in jail (Mandatory 6-month minimum jail term)

- Fines of up to $2500

- Mandatory revocation of driver's license for at least one year, and up to three years

- Class 5 Felony: First offense, with injury

- Up to 10 years in prison, 1-year minimum mandatory prison sentence

- Fines of up to $2500

- Mandatory revocation of driver's license for at least three years

- Class 4 Felony: Second or subsequent offense, no injury

- Up to 10 years in prison, or up to 5 years in jail

- Fines of up to $2500

- Mandatory revocation of driver's license for at least three years

- Class 3 Felony: Second or subsequent offense, with injury

- Up to 20 years in prison, 3-year minimum mandatory prison sentence

- Fines of up to $2500

- Mandatory revocation of driver's license for life

Additional penalties:

- Court-ordered restitution for any damage or injuries caused during the pursuit.

- Impoundment of the vehicle used in the chase.

- Requirement to complete a defensive driving course.

- Installation of an ignition interlock device in the offender's vehicle.

- Counseling or rehabilitation for alcohol and/or drug abuse, if applicable.
