In New York, a repossessing agent must first notify the owner of a vehicle that the vehicle is being repossessed before taking the vehicle. The repossessing agent must also provide the owner with an opportunity to satisfy the debt and prevent the repossession. This notification can be given orally or in writing, and it must include the following information:
* The name, address, and telephone number of the repossessing agent
* The name and address of the creditor
* The amount of the debt
* The date and time of the repossession
* The location where the vehicle can be redeemed
The owner must be allowed at least 10 days from the date of notification to satisfy the debt and prevent the repossession. If the owner does not satisfy the debt within the 10-day period, the repossessing agent may then repossess the vehicle.
In addition, a repossessing agent may not break into a locked car or building to repossess a vehicle. If the vehicle is located in a carport or garage, the repossessing agent must first obtain permission from the owner of the property before entering.
