As of January 2023, California does not impose fines on passengers above 16 years of age for failing to wear their seat belts. However, drivers will still be penalized for not wearing their seat belts, and they could be fined up to
$20, but the law will not fine the passenger or allow you to be stopped for the noncompliance of only that law. Drivers who failed to comply might also be given points on their driving record.
