Can a US citizen legally marry an Indonesian on tourist visa in the if already married abroad?

A US citizen can not legally marry an Indonesian who's in US on a tourist visa. According to the Indonesia embassy website, foreign nationals holding the type of visa required cannot enter a marriage in the United States for a duration between more than 1 month.
