Domestic Partner Health Coverage in Florida: Not Guaranteed by Law

Florida does not legally recognize domestic partnerships at the state level. Therefore, employers are not required to offer health benefits to an employee's domestic partner.

What This Means

  • No statutory right to enroll a domestic partner in employer-sponsored health plans.
  • No COBRA-equivalent continuation for domestic partners after job loss.
  • No tax equity: Imputed income on partner coverage (federal); no state-level gross-up.

Voluntary Employer Coverage

  • Some large employers (universities, hospitals, tech firms, multinationals) voluntarily extend benefits to domestic partners (same- or opposite-sex).
  • Typical requirements: affidavit of partnership, shared residence 6–12 months, financial interdependence, not married/related.
  • Check your HR benefits summary or SPD (Summary Plan Description).

Local Ordinances (Limited)

  • Miami-Dade, Broward, Palm Beach, Orange, Leon, Pinellas counties + some cities (Miami, Orlando, Tampa, St. Petersburg, Gainesville) have domestic partnership registries.
  • These grant limited local rights (hospital visitation, jail visitation, health care surrogate) — not health insurance mandates.

Alternatives

  • ACA Marketplace (HealthCare.gov) — partner can buy own plan; subsidies based on household income.
  • Marriage — grants full spousal benefits automatically.
  • Employer negotiation — some will add coverage if asked.
