Who has the right to evict a domestic partner in California?

In California, both domestic partners have equal rights to the shared residence, regardless of whose name is on the lease or mortgage agreement. Therefore, neither partner has the right to evict the other without a court order.

If one domestic partner wants to end the relationship and force the other partner to move out, they must either:

1. File a lawsuit for partition of the property if they co-own it through the court, or

2. Request a restraining order, in case of abuse, to remove their former partner from the shared residence
