Can you move out legally in Florida?

In Florida, tenants have certain legal rights and responsibilities when it comes to moving out of a rental property. These requirements are outlined in the Florida Statutes, Chapter 83.

Notice

One of the most important requirements is that tenants must provide their landlord with proper notice before moving out. The amount of notice required depends on the type of tenancy:

* Month-to-month tenancy: Tenants must provide at least 15 days' notice before moving out.

* Fixed-term lease: Tenants must provide at least 60 days' notice before moving out if the lease term is less than one year. If the lease term is one year or longer, tenants must provide at least 120 days' notice.

Rent and Security Deposit

Tenants are also responsible for paying rent and any applicable late fees until the end of their lease term. If the tenant moves out before the end of the lease term, they may be responsible for paying rent for the entire lease term, even if they do not live in the unit.

Tenants are also entitled to receive their security deposit back within 30 days of moving out, provided that they have met all of the terms of their lease agreement. If the landlord makes any deductions from the security deposit, they must provide the tenant with an itemized list of the deductions.

Moving Out Inspection

Before moving out, tenants should schedule a moving out inspection with their landlord. During the inspection, the landlord will assess the condition of the unit and note any damage. Tenants are responsible for repairing any damage they caused to the unit.

Keys

Tenants must return all keys to the unit to the landlord when they move out. Landlords may charge a fee for replacing lost keys.
