Are 4 wheelers legal on public roads in Maine?

In the State of Maine, it is illegal to operate an all-terrain vehicle (ATV) or "4-wheeler" on public roads. ATVs are defined as any motorized vehicle that has three or more low pressure tires, handles, and a seat which is straddled by the driver, and an engine that has a cubic capacity equal to or greater than ninety cc. ATV are specifically restricted in use to the following locations as set forth in the Maine Revised Statutes, Title 29-A §1001 -

* Upon established snowmobile trails;

* Upon an unimproved or temporary roadway used only by ATVs, snowmobiles, or other all-terrain vehicles;

* Upon public lands under the jurisdiction of:

* the Commissioner of Conservation

* the Board of Trustees for the University of Maine System,

* the Land Use Regulation Commission

* State Park and Public Land Commission

* the Commissioners of the Maine Forest Service

* the Commissioners of the Maine Bureau of Parks and Lands

* Upon private land with express permission of the owner;

* Across a public highway by the most direct route in order to cross to another unimproved or temporary roadway or public lands listed above.

Therefore, it is against the law to operate an ATV on public roads in Maine, except for a temporary crossing as specified in the statute. Violators may face fines and other penalties.
