The first step is to determine your relationship status. If you are not legally married, you will need to apply for a K-1 visa, which is a nonimmigrant visa for the fiancé(e) of a U.S. citizen. If you are already legally married, you can apply for an IR1 visa, which is an immediate relative visa for the spouse of a U.S. citizen.
Step 2: File a petition
Once you have determined your relationship status, you will need to file a petition with the U.S. Citizenship and Immigration Services (USCIS). The petition form is called the I-129F for the K-1 visa and I-130 for the IR1 visa. You will need to submit a number of documents with the petition, including:
* A copy of your birth certificate
* A copy of your passport
* A copy of your marriage certificate (if applicable)
* A copy of your fiancé(e)'s birth certificate
* A copy of your fiancé(e)'s passport
* A copy of your fiancé(e)'s police clearance certificate
* A copy of your financial documents to prove income support
* A copy of your evidence of relationship
Step 3. Go to your immigration interview
Once your fiancé receives the letter from the National Visa Center (NVC), you can start to prepare for your visa interview. The interview is typically held at the U.S. embassy or consulate in Honduras, and it will last anywhere from 30 minutes to an hour. You will be asked questions about your relationship, your plans for the future, and your financial situation.
Step 4. Enter the United States
When your visa is approved, you will need to enter the United States within 6 months. You must also enter before the expiration date of your fiance visa
Step 4: Interview with U.S. embassy
Once your petition has been approved, your fiancé(e) will be interviewed at a U.S. embassy or consulate in Honduras. The interview will be conducted in Spanish, and your fiancé(e) will be asked questions about your relationship, your plans for the future, and their ties to Honduras.
Step 5. Get married within 90 days of entering the US.
Once your Honduran fiance(e) enters the United States on their K-1 visa, you have 90 days to get married. The marriage must take place in the United States.
Step 5: Apply for adjustment of status
After your fiancé(e) has entered the United States, they will need to apply for adjustment of status to permanent resident. The application form is called the I-485. You will need to submit a number of additional documents with the application, including:
* A copy of your marriage certificate
* A copy of your fiancé(e)'s birth certificate
* A copy of your fiancé(e)'s police clearance certificate
* A copy of your fiancé(e)'s passport
* A copy of your financial documents to prove income support
Step 6: Get your green card
If your application for adjustment of status is approved, your fiancé(e) will be issued a green card, which is a permanent resident card. The green card will allow your fiancé(e) to live and work in the United States permanently.
