When Is a CDL Required in New York State?

You need a Commercial Driver's License (CDL) in NYS to operate any of the following in intrastate or interstate commerce:

Vehicle Classes Requiring CDL

• Class A: Combination vehicles GCWR ≥ 26,001 lbs, towed unit > 10,000 lbs GVWR.
• Class B: Single vehicle GVWR ≥ 26,001 lbs, or towing ≤ 10,000 lbs.
• Class C: Vehicle <26,001 lbs GVWR but:
  • Designed for ≥ 16 passengers (incl. driver); or
  • Placarded hazardous materials (any quantity).

Key NYS Specifics

• Fire trucks exempt (but not other emergency vehicles).
• Farm vehicles >18,000 lbs exempt within 150 air-miles of farm.
• HazMat endorsement (H) required for any placarded load; Tank (N), Doubles/Triples (T), Passenger (P), School Bus (S) as applicable.
• Intrastate only? Still need NYS CDL if vehicle meets above criteria.

Obtaining a NYS CDL

1. Pass vision test.
2. Pass written knowledge tests (General + endorsements).
3. Obtain Commercial Learner's Permit (CLP) – hold 14 days.
4. Pass skills test (pre-trip, basic control, road) in representative vehicle.
5. Provide identity, residency, SSN, medical card (DOT physical).

Penalties

Driving CMV without CDL: fines, license suspension, possible jail. Employer also liable.
