Is same-sex marriage legal in Botswana?

Same-sex marriage is not legal in Botswana. Although the constitution of Botswana does not explicitly prohibit same-sex marriage, the Marriage Act of 2013 defines marriage as a union between a man and a woman. In 2016, the High Court of Botswana dismissed a case brought by a same-sex couple seeking recognition of their marriage, ruling that the constitution does not guarantee the right to same-sex marriage.
