Temporary residency permit or removal order
* After being apprehended, undocumented immigrants are taken to a CBSA detention center.
* Here they are issued a temporary residency permit(TRP) if they:
* are a refugee claimant or have a pending application for permanent resident status,
* have been residing in Canada for extended period,
* have family members who are Canadian citizens or permanent residents,
* have contributed positively to Canadian society,
* have a medical condition that would make returning home problematic,
* Otherwise they will be issued a removal order.
Removal orders
* Removal orders require individuals to leave Canada within specified time (usually 30 days).
* Undocumented immigrants can appeal removal orders, but they must do so within a limited time.
Detention
* Undocumented immigrants may be detained while awaiting disposition of their case, such detention can last up to a year while proceedings or their appeal are underway.
* If an immigration hearing determines them inadmissible, they can continue to be detained until they can be removed to their country of origin.
* However, detention can be terminated under certain circumstances, for example if:
* the person has been detained for too long,
* they have an urgent medical condition, or
* they are a minor whose detention is no longer justified.
