Under the New York City Administrative Code, agencies can only require a resident to obtain an Identity Card if:
- The agency is authorized by law to provide the services or benefits in question.
- The Identity Card is necessary to ensure the efficient and effective delivery of the services or benefits.
- The Identity Card does not create an undue burden on the resident.
In addition, the agency must provide the resident with a written notice that explains why the Identity Card is required and how the resident can obtain one.
If a resident believes that an agency is requiring them to obtain an Identity Card in violation of the law, they can file a complaint with the New York City Commission on Human Rights.
