DIAC offers two types of Business Development visa: provisional and permanent. Business owners, senior executives, investors and independent executives can apply for a provisional visa to allow them a temporary entry into Australia. The provisional visa could lead to the permanent visa, which allows an established business person to stay indefinitely in Australia.
DIAC sets strict requirements for people who want to obtain the Business Development visa, and they vary depending on the particular type of business development involved. For example, the permanent Business Owner visa requires the applicant to employ at least two Australian residents, have a minimum annual turnover of AU$300,000 and a minimum asset value of AU$250,000, at least $100,000 of which is invested in the Australian business. The applicant also has to have a minimum of between 10 to 51 percent interest in the Australian business, depending on the size of the business.
In his first three years in Australia, the DIAC monitors the visa holder's compliance with visa requirements and the performance of his business. If he does not meet DIAC's requirements, DIAC might cancel his visa. In such a case, DIAC will first send a Notice of Intention to Consider Cancellation and allow the visa holder to request a review.
