How to Get a Pardon on a Passport

Entering the United States can be complicated enough for people with proper visas and documents. But if you have a criminal record in another country--even a misdemeanor such as driving under the influence-- the United States will probably deny you admission. Having a valid visa or being from a visa-waiver country will not exempt you. In order to still enter, you will need to apply for an entry waiver from the United States Department of Homeland Security in advance of your travel.

  1. Obtaining An Entry Waiver

      Download and complete a I-192 form from the website of the United States Citizenship and Immigration Services.

      Send the I-192 form with a $545 check or international money order to the United States Customs and Border Protection office at the port of entry you intend to use if you are in possession of a valid visa. However, do not do this if you have a U or T class non-immigrant visa. The addresses for the CBP port of entry offices are listed on CBP's website and checks should be made payable to the agency.

      Send the I-192 form to the USCIS Vermont Processing Center if you have a U or T class non-immigrant visa or if you are not sure about which port of entry you will use. The address is available on the USCIS website. Enclose a $545 check or international money order made out to the agency.

      Apply for a non-immigrant visa from your nearest U.S. embassy or consulate if you come from a visa waiver country such as Canada, the United Kingdom, France or Japan. Because you would not normally require a visa, your background will cause you to need one for the future.

      Wait to receive a written decision on your I-192 application from either CBP or USCIS by mail. Typically, a decision should come within 90 days. The agencies ask applicants not to contact them for status updates before this time period. However, there are status inquiry email addresses available for those whose decisions are delayed.
