How Can I Change My Status From M-1 to B-2?

An M-1 visa allows non-citizens to pursue a degree in the United States. Once your course of study has been completed, you are permitted to stay in the country legally for 30 days. However, should you want to visit the country for a longer period of time prior to leaving, you can apply for visitor's B-2 visa, which will grant the right to legally stay in the country for an additional amount of time, usually six months.

      Write a letter of intent stating the reasons for your status change request. Show in writing that your stay is temporary, and include information about the arrangements you have made to leave the country when your visa has expired. Include any information on how your extended stay in the United States would affect your foreign citizenship or employment.

      Complete the I-539 "Application To Change Or Extend Non-Immigrant Status" (see Resources).

      Make a copy of your original I-94 form that you received when you were granted entry into the United States. Include the written letter of intent, the I-94 form, the completed I-539 form and your filing fee and mail the complete packet to the direct filing address for the state in which you are residing (see Resources).

      Follow up on your application at your local office of U.S. Citizenship and Immigration Services (USCIS).
