Check the U.S. immigration stamp in your passport to confirm the date of expiration written. The expiration date in the passport should match the I-94 card, or landing card, given to you by the immigration officer. The dates should match.
Download forms I-130, I-485, I-864, and G-325A from the U.S. Customs and Immigration Services, USCIS, website. Print form G-325 in quadruplet and forms I-765 and I-131 from USCIS website.
Make a copy of your passport, including every page, even if blank. Photocopy your I-94 card and the biography page of your passport and spouse's passport in quadruplet. Photocopy your marriage certificate in quadruplet. Make copies your and your spouse's official birth certificates. Gather financial records that prove your spouse can afford to support you until you obtain work in the United States. It takes 90 days to receive work authorization after filing the form I-765.
Complete and sign the forms. Forms I-130 and I-864 must be completed by the U.S. Citizen. The I-864 form also must be notarized.
Two-hole punch the top of all documents. Staple together Form I-130 and copies of your marriage certificate, your and your spouse's passport biography page and your I-94 card, reflecting lawful entry into the United States and valid status. Attach copies of these same documents to the I-131 and I-765. Staple to each form. Staple a copy of your full passport, birth certificate, marriage certificate, spouse's passport biography page and copy of your I-94 card to Form I-485. Brad together all forms in this order from top to bottom: Form I-130 and supporting documents, Form I-485 and supporting documents, Form I-765 and supporting documents, Form I-131 and supporting documents, Form I-864 and financial documents and the four copies of G-325A.
Write your full name in pencil on the back of each passport-style photo. Attach two passport-style photos to forms I-131, I-765 and I-485.
Write and attach checks for applicable fees for form I-130 and Form I-485 to the petition packet. Forms I-765 and I-131 usually are included in the I-485 filing fee. Form G-325A does not require a fee.
Mail the petition to USCIS. Filing addresses for USCIS change frequently, so check USCIS website for current filing addresses.
